According to the Law “On the Protection of Consumer Rights”, you can return the goods back to Sportmaster. However, a number of goods of good quality cannot be returned or exchanged. The list of these goods is approved in the document: “List of non-food goods of proper quality that cannot be returned or exchanged for a similar product of a different change, shape, size, style, color or configuration.” These are the products:

  1. Products for the prevention and treatment of diseases at home (sanitary and hygiene items made of metal, rubber, textiles and other materials, medical instruments, instruments and equipment, oral hygiene products, spectacle lenses, child care items), medicines.
  2. Personal hygiene items (toothbrushes, combs, hairpins, hair curlers, wigs, hairpieces and other similar products).
  3. Perfume and cosmetic products.
  4. Textile goods (cotton, linen, silk, wool and synthetic fabrics, goods made from non-woven materials such as fabrics - ribbons, braid, lace and others); cable products (wires, cords, cables); construction and finishing materials (linoleum, film, carpets and others) and other goods sold by the meter.
  5. Sewing and knitted products (sewing and knitted linen products, hosiery products). Products and materials made entirely or partially from polymeric materials and in contact with food products (tableware and kitchen utensils, containers and packaging materials for storing and transporting food products, including for one-time use).
  6. Household chemicals, pesticides and agrochemicals.
  7. Household furniture (furniture sets and sets).
  8. Jewelry and other products made of precious metals and (or) precious stones, cut precious stones.
  9. Cars and motorbikes, trailers and numbered units for them; mobile means of small-scale mechanization of agricultural work; pleasure boats and other household watercraft.
  10. Technically complex household goods for which warranty periods are established (household metal-cutting and woodworking machines; household electrical machines and appliances; household radio-electronic equipment; household computing and copying equipment; photographic and film equipment; telephones and fax equipment; electric musical instruments; electronic toys, household gas equipment and devices; wrist and pocket watches, mechanical, electronic-mechanical and electronic, with two or more functions).
  11. Civilian weapons, main parts of civilian and service firearms, ammunition for them.

Is it possible to return?

According to the Law of the Russian Federation dated 02/07/1992 N 2300-1 “On the Protection of Consumer Rights,” the buyer can return the product and get the money back.

This can be done if three conditions are met:

  1. If you return a product of good quality, but not suitable for certain reasons , you must return the money within 14 days after purchase. At the same time, the product must not show any defects or signs of use.
  2. If you return a product of inadequate quality and defects occur , you can return the product within a “reasonable time”. Usually within 1-2 years if there are defects on the part of the manufacturing company.
  3. The product must not be classified as non-returnable. These are personal hygiene items, textile items and linen, items made of polymers that come into contact with food, non-periodical printed publications (magazines).

The Sportmaster store is obliged to follow these rules. Within 14 days, the seller is obliged to return the money for any product. After 14 days - only for goods of inadequate quality.

Purchases that are included in the non-returnable list cannot be returned to the store in any way.

During the first 14 days and 1 month from the date of purchase there are no problems with returns. It is necessary to preserve the presentation of the product and leave all tags and labels. Difficulties may arise when returning low-quality goods after a certain period of time. Store employees most often do not undertake additional examinations.

The law in matters of returning goods is on the consumer's side. During the entire shelf life and warranty period, the buyer can return a product of inadequate quality and modern stores cannot refuse it. The consumer has many levers of pressure on any retail chain.

When is a product free of defects?

A product that is of satisfactory quality may be returned to the store. The legal return time is 14 days, excluding the day of purchase.

Returns often concern clothing and shoes. If the item doesn't fit, you can always return it. An exchange for a product of a different size or color is possible if the corresponding product is available in the store. If it is not there, the buyer’s money is returned.

According to the Law, the buyer has 2 weeks to return an unsuitable item purchased from an online store. In the absence of written notification about the procedure and terms of return, the delivery time increases to 90 days.

Deadlines

How many days after purchase the buyer has to return depends on the reasons.

If a product was purchased of good quality , but did not fit due to objective or subjective reasons: size, color, material, then the client can return the product within 14 days from the date of purchase. The day of purchase does not count toward the countdown.

If Sportmaster sold a product of inadequate quality , then it can be returned within the entire period of use. The law and Rospotrebnadzor are on the consumer’s side here, but lawyers say that the period “must be reasonable.” If within 1–2 years the product has received defects that are not related to poor storage and use, it must also be returned.

In some cases, if there is doubt about use, the product must undergo examination. A store employee will tell you how long a return or exchange is possible.

How to return a jacket

The jacket does not belong to the category of conditionally non-returnable goods from government decree No. 55. Therefore, it can be returned on a general basis:

How to return a down jacket

Warm sportswear, such as ski suits or down jackets, are returned on a general basis. Such an item can be returned both in the presence of a manufacturing defect and in its absence. The difference lies in the return period (see above). In the latter case, the item must retain its original presentation.

Conditions

There are several conditions under which you can return the product to the store. Only if they are observed does the buyer have the legal right to claim a refund.

What items are accepted back?

You can return almost any product to Sportmaster:

  • clothes;
  • shoes;
  • Sports Equipment;
  • simulators.

To do this, several conditions must be met:

  • all tags and price tags are preserved on the packaging and on the product itself;
  • the product is returned with the same quality as it was;
  • no visible signs of use.

This only applies to items returned within 14 days.

If the product has been in use for more than 14 days and hidden defects have been discovered that affected it, compliance with the previous conditions is not required. In this case, sellers need to send the goods for examination to identify the cause.

Which ones are not accepted?

Cannot be returned:

  • underwear (thermal underwear);
  • hosiery and swimwear.

If they are not found to be defective, they cannot be returned within 14 days. If, after coming home, the buyer finds defects and does not have time to wear these goods even once, he can return to the store and get a refund.

Difficulties usually arise with hosiery and thermal underwear.

Without obvious defects, sellers refuse to accept such goods back. It is necessary to write a claim, to prove that the defects were there initially and did not arise during wear. Only after this the store will return the money.

Can I go to any store in the chain?

Returning goods is possible in any store of the same chain , if they are the same legal entity. Sportmaster stores are opened under one legal entity, so returning to another store in the chain is possible.

The seller of another store has no right to refuse. Even if he refers to the fact that this store has nothing to do with it. Points of sale belonging to the same network must return money for goods, regardless of where they were purchased.

When the product is defective. Who performs the defect examination?

There is no need to immediately leave the place of purchase when it is made in the store. It is important to carefully check that all parts are present and that there are no scratches or chips. If the defect was discovered already at home, the buyer has the right to demand from the store:

  • replacing the product with a similar one, but of the required quality;
  • termination of the contract and full payment of funds for the cost of low-quality goods.

If the defect is minor, the Law allows the store to require the following:

  1. proportional reduction in price for goods;
  2. elimination of the existing defect at the expense of the seller;
  3. reimbursement of funds for expenses associated with eliminating defects.

When delivering a product ordered online, it is recommended to carefully inspect it for any discrepancies: scratches, deformations, chips. If they are found, this should be noted in the Delivery Certificate. Such a document is drawn up in two copies.

If the product is disassembled and delivered unassembled, this information should also be provided.

The buyer must return the defective product to the store BEFORE the warranty expires. If the product weighs more than 5 kg, the online store must provide delivery to the customer’s service point.

How to return a purchase?

The procedure for returning goods at Sportmaster is extremely simple: the client must come to the seller’s checkout, fill out an application and wait to receive the money. Difficulties can only arise if the seller deliberately tries to prevent returns for his own interests.

With a check

The procedure for returning goods along with a receipt is as follows:

  1. A buyer comes to the Sportmaster store. Any store in the chain will do, not even the one where the purchase was made.
  2. You must approach the seller at the checkout and inform them of your intention to return the goods. Most often, the employee will call the manager, who will further resolve this issue.
  3. When talking with the manager, you must describe the reason for the return. If all requirements are legal, the employee will check the tags (return within 14 days), condition and compare with what it was at the time of purchase.
  4. If everything is correct, the manager provides the client with a form for a refund. You must provide personal information, product, reason for return and details.

There are no difficulties if there is a receipt and all tags are present.

If you have a receipt and confirmation of purchase, but are missing any tags, the store will not return the money and the law is completely on its side.

Without a receipt

The procedure for returning goods without a receipt is similar to the previous one. With one difference: employees may prevent the buyer from returning. According to the consumer protection law, the store is obliged to return the money in the absence of a receipt, if it has other evidence of the purchase of the goods.

The return procedure is as follows:

  1. The buyer comes to the store and contacts the seller that he wants to return the product. Sportmaster has the ability to restore a receipt, and also has cameras at the checkout.
  2. The employee can independently restore the receipt from the database or refuse to do so, since it was not his fault that the buyer lost the receipt.
  3. If the employee refuses, you can use: sales receipt, extracts from the repair shop, testimony of witnesses.
  4. If the issue with evidence is resolved, the buyer submits a return claim in writing and submits the document to the manager.

Difficulties in this procedure may arise when collecting proof of purchase. If the product is in the database, then Sportmaster cash registers can restore the receipt. If you do not have a receipt, it is better to contact the same store where the purchase was made.

Via online store

The return procedure for purchasing through an online store is different. The return period in this case is 7 days. It is important to comply with several conditions:

  • Open the parcel only on camera. If the client does not record the moment of opening the parcel, the online store can always say that another product of good quality was sent;
  • Calculate the cost of return taking into account the parcel. Even if the website indicates free delivery, it will not be the same for the company. Shipping costs are deducted from the refund;
  • Returns can be issued at any store in the chain. This is enshrined at the legislative level.

Sportmaster has the following return scheme: if it is not a large product, then it must be taken to the nearest store. Scheme of work:

  1. The client brings the purchase along with the receipt to the nearest store. The salesperson at the checkout examines the issue and calls the manager or senior salesperson to issue a return;
  2. If employees insist, it is necessary to show a record of the opening of the parcel;
  3. If all formalities are met, the money is given to the client.

For large purchases (weighing more than 31 kg), you can use the services of a courier.

The service is available for Moscow and Moscow Region; St. Petersburg and Leningrad region, Yekaterinburg and Sverdlovsk region. The courier is ordered from the online store website.

For various reasons, deadlines have been established for the implementation of buyer requirements. If the reason for the return is a defect, then such a period will depend, first of all, on the intentions and capabilities of the seller. According to the general rules, the replacement period is seven actual days from the date of application.

In practice, it does not last more than three. If the seller does not have an analogue, then this period will be thirty days. When additional verification is carried out, the exchange period can last up to twenty days.

When the buyer is not satisfied with the product due to size, style, configuration, dimensions or color, the exchange must occur within two actual weeks. This period does not include the day of purchase.

Refund

The buyer can return money for products that do not meet quality standards or do not suit him for personal reasons. Such a requirement must be fulfilled within ten days of its presentation. To do this, the buyer will need to provide the seller with a receipt indicating how much the product costs.

In case of loss of a document, a person can use witness explanations. Refunds will be made in the same order in which they were deposited. For example, with a non-cash payment, everything will be transferred to the client’s bank card. In practice, this procedure is implemented within no more than five days.

Deadline for visiting the store

The products offered by Sportmaster are subject to all the rules established by the PZPP without exception. Accordingly, the buyer can make claims during the accepted warranty period.

This period is determined by the manufacturer and depends on the type of product. If the manufacturer has not set the specified period, the seller has the right to do so, and assumes the obligation to consider claims.

When the guarantee has not been determined initially, the buyer can make his claims within two years, provided that a longer period is not specified in the law or the sales agreement.

If the service life was less than twenty-four months, then claims can be made even after its expiration. In this case, the buyer will have to prove that the defect occurred before the purchase of the goods.

Return of low-quality goods

Returning an improper product to the seller, that is, not meeting the requirements of quality standards, has its own characteristics. In this case, Sportmaster will reimburse its client not only the full cost of the product, but also all costs associated with its transportation.

To return the defect, the buyer will have to provide a receipt, contract and warranty card, as well as the product itself.

The fact of transfer of the product is documented in an act. Most often, the seller sends the product for examination to determine the nature and causes of the defects. Based on the results of the assessment, it will be possible to determine the guilty party. If the examination confirms that the person has nothing to do with the defects that have arisen, the goods will be accepted and the money will be returned to the buyer.

Procedure for filing claims

If the buyer intends to return the goods to Sportmaster, he is obliged to file a claim. Its form depends on the method of purchase, since the specified seller sells its products both at retail outlets and through online stores when a person wants to cancel the order.
