How to write a complaint against the district commissariat

In order for the claims presented to the military registration and enlistment office to help resolve the issue, the conscript must correctly formulate the appeal. In this case, the reasons must be objective, based on real facts that have documentary evidence.

The answer to the question of how to write a complaint to the military registration and enlistment office also depends on where you plan to submit the document and on the nature of the complaint itself. For example, the procedure for filing a complaint in court, the form and content of the statement of claim, incl. the attached package of documents is determined by the current legislation (Civil Procedure Code of the Russian Federation, Articles 131, 132).

In this case, it is important not only to correctly fill out all the necessary documents, but also to determine the addressee to whom the complaint is sent, i.e. judicial authority of the appropriate level. For example, there is a city (district) and a magistrate court.

In the Russian judicial system, there are still specialized military courts, where citizens liable for military service can also file a complaint against the district military registration and enlistment office. But young guys who are not actually military personnel yet are advised to apply to civilian courts if they have any complaints. In this case, it is recommended to submit a complaint in advance, because Such legal proceedings often drag on for several months. The complaint can also be sent to other authorities:

  1. Directly to the Russian Defense Ministry;
  2. To the prosecutor's office;
  3. Chairman of the draft commission;
  4. To the leadership of the commissariat.

According to Russian legislation (Federal Law No. 59), no more than 30 days are provided for consideration of a claim after registration of the corresponding application. At the same time, the complaint itself and the accompanying papers must be correctly drawn up, otherwise they may be returned for revision, and accordingly, the consideration period may be legally extended.
