How to return a wallet with a defect under warranty?

Has it been less than 15 days?

If a defect is detected within the first 15 days from the date of delivery of the goods, then you have the right to return the goods or exchange them for the same or similar ones with a recalculation of the price.

Important: the countdown of the period begins from the moment the goods are received. If you paid for the product and it was delivered to you a week later, then the non-guaranteed return period is calculated from the day of delivery.

The money must be returned to you within 10 days, and a replacement must be provided within 7 days from the date of application (if with quality control, then within 20 days).

Important: if the price of a product has increased since the date of purchase, you have the right to demand compensation for the difference in price.

Has it been more than 15 days?

After this period, you can only count on warranty repairs of the product.

Although, if the repair lasts more than 45 days, or the fault turns out to be unrepairable or recurring, then you have the opportunity to demand a replacement or refund.

You can also demand compensation for losses associated with the sale of a device of inadequate quality to you. For example, compensation for the costs of transporting goods to the place of repair.

Replacement during repair

While you are waiting for the product to be repaired or replaced, you can request a replacement from the seller during this period. You must be provided with a replacement within 3 days.

How to return a damaged wallet under warranty

  1. if the warranty period has not expired, you should contact the seller (manufacturer, importer) with a written claim, drawn up in two copies, with clearly stated requirements (copies of all necessary documents are attached to the claim, for example, a sales receipt, sales receipt, warranty card, etc. .).

  4. If you and the seller have a dispute about the causes of the malfunction, the seller is obliged to conduct an independent examination (where you can also be present) at his own expense. If, on the contrary, the defect arose during operation, then you will be left with faulty goods and will be required to pay the seller the costs of conducting the examination.
  5. If the consumer does not agree with the seller and the results of the examinations, then he has the right to file a claim in court.

If the product is of poor quality

Having discovered a manufacturing defect or some defect in the purchased product, the buyer may demand:

  • exchange defective goods for a high-quality analogue;
  • exchange low-quality goods for goods of a different brand and value (with recalculation);
  • eliminate the defect by submitting it to the store service;
  • reduce the cost of goods due to identified defects;
  • return the full cost of the product in exchange for the return of the product itself.

When returning an incorrect item, the buyer will need:

  • the product itself. Traces of use or slight loss of presentation are acceptable;
  • a receipt confirming the date and place of its purchase;
  • passport for filling out a return claim;
  • warranty card (if available).

When visiting the store you should:

  • provide the product and explain why it is defective;
  • fill out a claim form for returning goods of inadequate quality in two copies.

If the reason for the defect is not clear at first glance, the seller will offer to send the goods for examination, which will determine the root cause. If the inspection reveals a manufacturing defect, the buyer's requirements specified in the complaint will be fully satisfied. However, if the results of the inspection show that the goods were damaged due to improper use, it is highly likely that the application will be denied.

Good quality

If the item has not yet been delivered to you, you can already refuse it. After the transfer you can cancel within seven days . The quality of goods is regulated by the State Quality Standard (GOST) or technical production conditions (TO), which is indicated in the relevant accompanying documentation.

According to Article 4 of the Law “On Protection of Consumer Rights”, the seller is obliged to provide the buyer with a product suitable for use and corresponding to the description, taking into account its expiration date and service life.

If all standards are observed, the wallet is a product of proper quality.

Conditions

Based on paragraph 1 of Article 25 of the Law “On Protection of Consumer Rights”, the seller is obliged to accept goods of proper quality subject to the following conditions:

  • The product has not been used
  • Presentation and packaging preserved
  • There is no violation of labels and seals
  • Availability of cash or sales receipts

If the receipt is missing, then a refund is possible, supported by witness testimony.

If the wallet was purchased in an online store, then an electronic payment document can be used as evidence.

Procedure

The buyer must perform the following actions:

  1. Draw up an application in 2 copies and give it to the seller. One copy remains with the buyer, and a mark indicating acceptance of the application is placed on it. The second copy remains with the seller.
  2. Give the wallet to the seller in its entire package. In this case, labels and seals must be intact. After delivery, the buyer’s copy is marked with acceptance of the goods.
  3. Present a document confirming the purchase of the goods at this particular outlet.
  4. Provide an identification document.

The application must indicate the requirement. That is, what is needed, a refund or exchange of goods. The seller is obliged to satisfy this requirement within no more than 3 days from the date of filing the application.

Refusal to accept the application

If the seller refuses to accept the application, it must be sent to the store by registered mail with notification of receipt. In this case, the recipient must be the head of the outlet. The name of the manager can be found in the “Consumer Corner”, which is in every store. The recipient's address must be actual, not legal.

If the return period has expired

The Law on Consumer Rights clearly defines return periods. It was decided that 14 days is enough for the buyer to decide whether he needs the product.

Return to the online store

When purchasing a product in an online store, the purchase and sale agreement or accompanying documentation may specify a return period of 7 days. If there is no such clause, then the period for returning the wallet can be extended to 90 days.

All steps for processing a return are the same as for any retail outlet. In the absence of a cash receipt, it is acceptable to attach to the application an extract from electronic payments or a bank receipt that confirms the fact of payment.

With such a return, it is necessary to take into account that the payment is returned minus the transport costs incurred by the seller to deliver the goods, but only in cases where they are not paid separately.

Return by organization

In trade cooperation, a sales contract is always concluded between organizations. If it is necessary to return the goods, it is carried out in accordance with this agreement.

In some cases, with the consent of the seller, a reverse sale and purchase transaction is concluded, according to which the seller and buyer change places.

A product of poor quality or defective is considered to be one that has deviations from the normal one.

However, it is not possible to return the goods in the following cases:

  1. If the defect arose due to the actions of the buyer;

  • To return and receive money;
  • To exchange the product for a new one with the same declared characteristics;
  • To carry out repairs free of charge;
  • To exchange for a product with other characteristics with payment of the difference in price
  • By agreement of the parties, a reduction in the price of the product equal to the amount of the defect found.

Procedure

  • Describe the list of documents attached to the claim.

In this case, the following documents must be attached to the claim:

  • a copy of the sales or cash receipt;
  • a copy of the warranty card;
  • invoice;

It is worth considering that in situations where the consumer does not have sales receipts, the claim must still be accepted. In the form of evidence, you can use the testimony of witnesses, information about the purchase that is available in the database, information from video cameras.

Claim consideration period

In the subsequent period, the claim is reviewed by the seller's responsible person.

  • If the buyer requests an exchange of the wallet, the review may take about 7 days. During this period, all required checks are carried out;
  • If the buyer wants to return money for a defective product, the seller will have 10 days to write a response. If the result is positive, then the buyer will be paid all the money spent;
  • The responsible person of the seller may refuse to accept the goods and return the money to the buyer. This happens in situations where the item has become unusable due to the fault of the buyer;
  • If the product is defective due to the fault of the seller or the transport company, compensation may be denied. To do this, a special examination is performed, which allows us to determine what caused the malfunction.

Refund deadlines

It is worth remembering that for each day of delay the guilty party pays a penalty, its amount is established in accordance with the contract. If this issue is carried out without a contract, then the amount of the penalty will be equal to 1% of the cost of the goods.

An exchange of a non-food product of proper quality is carried out if the specified product has not been used, its presentation, consumer properties, seals, factory labels are preserved, and there is also a sales receipt or cash receipt or other document confirming payment for the specified product. Discounted items cannot be returned or exchanged

In principle, a markdown is the same discount that the seller has the right to make at his own discretion. Many buyers mistakenly believe that the sale of discounted goods occurs when they are defective or have some kind of malfunction.

So, the buyer must know that in relation to those items that have been marked down, the same rights apply as in relation to goods of standard value. These include: the right to warranty service, to return goods and to exchange them.

Remember: The consumer is not required to know why the product is discounted or why the product is sold at a discount! The consumer is not obliged to know what the seller was guided by when marking down the product or making a discount on it! Legal basis for the exchange of goods of good quality. It follows from this that the buyer has the right to return absolutely any item to the store that he simply did not like based on one of the listed characteristics.

At the same time, he has the right to either return the item in exchange for the money spent, one hundred percent of the cost, without deductions, or exchange it for an item of a similar price category of a different color, style, size or configuration. If he chooses a more expensive item, he will have to pay the difference in cost. Any person at least once in his life has a situation when one or another product did not fit, turned out to be defective, broke, and so on.

And a problem arises: how to return the product to the store or exchange it? There are different situations and different options for dealing with them. Let's try to consider them sequentially. We return goods of proper quality. We will talk about cases when you bought a product of normal quality. The product must be non-food. You can return and exchange an item if it does not meet the following parameters:. In general, you are not required to explain why the product did not suit you.

It doesn't matter. You have the right to exchange the product if fourteen days have not yet passed from the date of purchase. In this case, the day of purchase is not taken into account. State your demand on paper, in writing or in print, that is, you need to send a claim to the seller, demanding a refund or exchange of low-quality goods. You need to hand such a claim to the seller personally, and your copy should bear the date of acceptance of the claim, the name of the person who accepted it, the position and his signature or the seal of the organization.

Keep your copy with all the marks, this is proof that you contacted the seller. Within 10 days, your claim must receive a response using the method of communication you specified; if there is no response or your demands are denied, then you have the right to go to court to protect your rights. You can warn the seller about this in the text of the claim.

Most often at this stage the situation is resolved in your favor, since no one wants to run around the courts. We recommend preparing a written complaint in advance, before going to the store. Especially if the product is expensive. This will subsequently serve as proof that you made legal demands to the seller, but he did not fulfill them. If you ask to replace the product, the seller must do this within 7 days from the date of your request. There is a ten-day deadline to satisfy all other requirements.

What makes a purse different from clothes and shoes is the fact that such an object has a warranty period.

Using this period, you can return the wallet within the specified period specified by the store in the warranty, which usually does not exceed more than 2 years from the date of purchase. By purchasing a wallet in good condition, a citizen as a buyer can return it to the store in normal condition within the first two weeks from the date of purchase.

Guided by this legal right, any citizen has the opportunity to freely make a return and receive back the amounts paid. In addition, in addition to returning the wallet, a citizen has the right to replace the product. When making all returns in a store, you must follow all the prescribed rules in force in the consumer protection law. The first chapter of the law on the protection of consumer rights, on the basis of existing articles, provides the opportunity to establish liability and resolve all arising disputes and disagreements under the terms of this type of contract.

In the event of any conflict situations that were formed during the commission of return actions, the buyer of the purse has two outcomes of action - the conflict is resolved out of court or, in the absence of consensus, in court.

Having paid the price of the product indicated on the receipt, the purchaser must receive it in hand. The seller issues the purse in the prescribed form and proper quality. According to the concluded transaction, the purchased wallet will be recognized as the object of the agreement, which relates to civil and consumer legislation and its reference norms. Referring to Article 25 of the ZPPP and its contents, an individual as a buyer has every right to return the wallet to the store as the supplier of the goods.

Having bought a wallet and started using it, a citizen may find external damage or manufacturing defects in it. This will also be the legal right to return goods to the store. Based on the situation itself, a citizen, on the basis of the first chapter of the PZPP, may also receive the right to reimbursement of all costs associated with payment for this object. After purchase, the warranty period begins.

If during this period the buyer discovers damage or defects, he has the right to return them to the store in accordance with the rules prescribed in the purchase and sale agreement. When returning a purse, taking into account the warranty case, the buyer must also refer to the articles of the PPA and present to the sellers themselves the reasons for this, since in some cases the store unreasonably refuses to perform such an action.

Also, in addition to the warranty case, the legislator establishes another procedure that makes it possible to replace or return a wallet in any case or reason. Having purchased a wallet within the first 14 days, you can safely return it due to a mismatch in size or another basis for this established by law. Guided by the definition prescribed in the list, it is noted that the wallet is not included in the established document.

Its characteristics are not reflected in more than one list of goods that cannot be returned in proper quality. Using this definition based on the current document, we can conclude that the wallet does not fall under more than one category, since it is not part of the kit and does not have technical means. This makes it possible to legally establish that any grounds for return other than discovery of a defect may apply. When, after purchase, a citizen determines that the purse is of inadequate quality, he has every right to independently initiate the process of returning the goods.

The first step in initiating a return will be to visit the point of sale where the defective product was purchased. After this, the administrator or the seller himself who made the sale should state the reason why he requires a replacement of the purchased product, after which he formalizes these claims in writing with all the points indicating the grounds for returning the purse of inadequate quality.

After completing all the paperwork provided for replacement, they will be sent to the store administration. After the administration receives all the papers issued for return or exchange from the applicant, the complaint will be considered and a decision will be made on it within a few working days.
