In the Moscow region, the procedure for winter cleaning is regulated by Law No. 191/2014-OZ “On improvement in the Moscow region.”

According to the regulations, as soon as a warning is received from the meteorological service about the onset of snowfall, the roadways, overpasses, and bridges must be treated with deicing agents. It is also necessary to prepare and clear areas for temporary snow storage in advance.

Within four hours from the beginning of the snowfall, sidewalks and other pedestrian areas must be treated with anti-icing materials.

During the first 12 hours after the end of the snowfall, utility workers must clear public transport stops, internal driveways, container sites and their entrances, sidewalks and other pedestrian areas from snow and ice.

Within 24 hours after the end of the snowfall, snow is first removed from public transport stops, ground pedestrian crossings, from bridges and overpasses, from large shopping centers, markets, hotels, train stations, theaters, entrances to hospitals and other social facilities.

Snow must be removed from streets and driveways within three days to ensure road safety.

Within five days after a snowfall, utility workers must clear the remaining areas of snow.

The owners are required to clean areas near shops, beauty salons, restaurants and cafes.

Utilities can temporarily store snow in parks, forest parks, gardens, public gardens, boulevards and on specially prepared sites.

If we formulate the answer to the question whether it is possible to recover payment for a hole, pothole or hatch on the road, as briefly as possible, then we will get one of 2 options: if the hole does not comply with GOST, or the hatch was closed and made within the limits of the law, then the driver in practice In 2021, a violation of paragraph 10.1 of the Rules will be issued (the speed was not selected taking into account the road situation). If there is a violation on the part of road workers or another organization servicing this section of the road, then the blame most often falls on them.

What are the permissible pit dimensions according to GOST?

It is noteworthy that in Russia there has long been a special regulation that regulates the condition of holes, potholes and other irregularities on the road. According to GOST R 50597-93, the maximum dimensions of road recesses should not exceed:

  • 15 cm long,
  • 60 cm wide,
  • 5 cm deep.

If the size of the pothole is greater than at least one of the specified limits, then the organization responsible for maintaining the roads can be held liable.

Can a manhole on the road be open?

The hatch is part of the city’s engineering network, for which operating organizations are responsible. As a general rule, the hatch, of course, must be closed. If part of the water supply system is open, then the operating organization must compensate for the damage. In this case, it does not matter whether the hatch is fully open or partially open, or if it turns out to be broken.

But please note that the hatch may be open in case of repairs and other work in the relevant area. But even in such a situation, the operating organization must fence off the work area from traffic. If the area was properly fenced, but the driver did not keep an eye on the road (and again 10.1 of the Rules), then no one will compensate him for the damage. On the contrary, it is you who will pay for the damaged fences.

If I am charged with violating clause 10.1 of the traffic rules?

Paragraph 10.1 of the traffic rules is an “insidious” norm, first of all, for drivers. The reason is in its content, which imposes general responsibility for road traffic on the motorist. The driver must not only comply with the speed limit set. He also needs to assess traffic intensity, road, meteorological and other conditions in advance.

In practice in 2021, this point turns out to be a precedent. This means that if a driver could have foreseen a large pothole and avoided it without harming other road users, then he himself will be largely to blame for hitting a pothole or manhole at speed.

The imputation of clause 10.1 of the traffic rules is an extremely common phenomenon, from which one can and should be protected. The size of the hole and the circumstances of the case as a whole will be of key importance. You will need to prove that you could not foresee the danger of a collision with a deep hole, which would result in material damage to the car.

Thus, the main task immediately after such an accident has occurred is to make sure that there are no grounds for making a determination for violation of clause 10.1. How to do this?

Actually, nothing complicated. The traffic police officers who arrive at the scene of the accident will give you a piece of paper on which you will write an explanation. It is here that, among other things, it is necessary to indicate approximately the following.

I was moving along the specified road at a speed [your speed should not be higher than that established for this section - and no +20 km/h non-fine threshold] taking into account the intensity of traffic, weather and road conditions and the characteristics of my vehicle, road surface [ dry/wet], time of day [dark/light]. The speed I chose ensured that I could remain in constant control of the direction of travel of a hazard that I could foresee.

Such explanations actually mean your unquestioning compliance with this point. In such a situation, you essentially remain innocent until proven otherwise, and traffic police officers are unlikely to do this right here and now.

If, nevertheless, a ruling has been made against you (a ruling for violation of 10.1 is not issued, since in 2021 there is no punishment for its violation), then you must appeal it. Actually, in the reasoning part of the complaint, you can indicate the same thing that we cited above - there should be no other evidence of violation of 10.1, unless, of course, you really complied with this paragraph.

However, the likelihood that you yourself will be the culprit of hitting a hatch or hole may be high in the following cases:

  • if you really exceeded the speed limit and because of this you fell into a hole without noticing it in time (for example, in this section the limit is 40 km/h, and you were driving 45),
  • if at that time there was poor visibility of the road (rain, snowfall, fog), but you were driving at a speed close to the limited speed (in the same example, 38 km/h),
  • if there was ice and you were again driving almost at the established speed limit.
