Let us remind you that the Federal Tax Service has the right to send documents to the taxpayer in three ways: in person against signature, by registered mail, or in electronic form through an electronic document management operator. If a taxpayer is required to submit reports electronically (this applies to organizations and individual entrepreneurs with an average number of employees of more than 100 people), then the inspectorate is also obliged to send documents via telecommunication channels. In relation to other taxpayers, inspectors have freedom of choice.

Certain situations in the Tax Code are specifically discussed. For example, it is stated that in the case of an on-site inspection, the inspector should, if possible, hand over documents in person. And only if there is not a single representative of the taxpayer in the audited territory who has the right or power of attorney to receive the claim, it must be sent by mail (clause 1 of Article 93 of the Tax Code). The new edition of clause 4 of Article 31 of the Tax Code states that “in cases where a document is sent by the tax authority by registered mail, the date of its receipt is considered to be the sixth day from the date of sending the registered letter.” After this deadline, the request is automatically considered received, and the tax authority does not have to prove the fact of its receipt by the taxpayer.

The difference is exactly one day down. The calculation starts from the next day after sending the correspondence (it is considered the first day), only working days are taken into account.”

The date of receipt of documents from the tax office is legally significant, since the deadlines for fulfilling the requirement, submitting objections and complaints are counted from it, in turn. The situation is aggravated by the fact that, in accordance with the new amendments, the tax office sends correspondence exclusively to the legal address of the organization. As for individuals (individual entrepreneurs, lawyers, notaries), they have the right to indicate in the corresponding application the address for delivery of correspondence, which will differ from the one registered in the Unified State Register of Real Estate.
