Responsibilities and rights of carriers

The rights and obligations of the carrier are indicated in Art. 14 No. 442-FZ. This Federal Law stipulates the basics of organizing the transportation of passengers by off-street transport, as well as the legal aspects of the functioning of railway communication.

What are the responsibilities of railway carriers?

The carrier is obliged:

  1. Provide transportation services in accordance with the approved transport schedule and in accordance with established tariffs;
  2. Comply with the requirements for the operation of transport;
  3. Conclude a compulsory insurance agreement in accordance with Federal Law No. of June 14, 2012, protecting the life, health and property of railway passengers;
  4. Conclude an insurance contract on the basis of No. 225-FZ dated July 27, 2010, which insures harm caused to a passenger as a result of an accident at a dangerous facility;
  5. In case of damage to the life, health or property of passengers, the transportation organizer must compensate for the damage caused.

The carrier must also comply with other requirements in the field of railway transportation established by Russian legislation.

What rights do railway carriers have in relation to passengers?

The carrier has the right to terminate the contract for the provision of transportation services and disembark the passenger if he does not comply with the rules for using off-street transport.

Selecting a car category

You can change the category of the carriage within 24 hours. There are two solutions to the issue:

  1. Select a higher level . In this case, the client pays the difference in cost;
  2. A person who is already traveling a long distance has the right to ask to be moved to a higher category carriage.

  3. Downgrade . In this situation, the citizen is refunded an amount equal to the difference in price.

You can contact the head of the train through the conductor. If there are free places, movement is allowed.

In this case, the person must pay the difference in price and pay for the re-registration procedure.

Luggage transportation

Each seat purchased by a person, including a separate seat for a child, corresponds to three pieces of baggage. At the same time, there are certain requirements for the technical characteristics of luggage :

  • size – up to 180 cm;
  • unit weight - up to 75 kg;
  • total weight - up to 200 kg.

Items that may be damaged during travel must be packed properly . This type of luggage must be marked with a special mark. Such things, for example, include: equipment, electrical appliances, glass.

It is prohibited to transport items that may harm other citizens, their luggage, or train service personnel (weapons, explosives, flammable substances).

Travel for children

The cost and rules for transporting children depend on their age :

  1. up to 5 years old – free of charge when sharing the same seat with an adult;
  2. up to 5 years - paid at existing rates when placed in a separate place;
  3. from 5 to 10 years – paid at existing preferential rates;
  4. after 10 years - paid for an adult ticket;
  5. from 7 years old - paid for an adult ticket (suburban service).

The age determination date is the day of travel. That is, if a child is under 5 years old at the time parents purchase tickets, but will be 5 years old on the departure date, it is necessary to purchase a separate travel document for him.

Children under 10 years old can only travel if accompanied by an adult . An exception is the travel of students to their educational organization.

Rights of Russian Railways passengers in 2021

Unfortunately, the cost of tickets for many Russian Railways passengers seems overpriced, especially when it comes to traveling in a compartment rather than a reserved seat. In any case, the ticket price can be reduced. The fare depends on the following factors:

  • the season in which the trip is made - for example, in summer the price for southern destinations is always higher;
  • number of free seats - the fewer there are, the higher the price of the last tickets;
  • ordering time – the earlier you purchase tickets, the lower their price will be.

In order not to overpay for travel, Russian Railways employees advise purchasing tickets in advance. Better - 1.5 months before the date of dispatch. This way you can save money on your trip, and there will be more choice of places.

Long journeys or waiting for your train are often accompanied by the need to visit the restroom. As you know, going there at the train stations costs a fee, but not for everyone. So, if you have a train ticket in your hands, then they should not take money from you for going to the toilet. But there are time limits here:

  • before departure – 3 hours before departure time;
  • after arrival – 1 hour.

By the way, this rule applies not only at railway stations, but also at bus stations, ports, and stations. The main thing is to show your ticket when going to the toilet.

The passenger has the right to carry luggage free of charge, but there are some restrictions. Regarding the weight of luggage:

  • no more than 36 kg - if you have a ticket from a reserved seat;
  • up to 50 kg – if the move is in a compartment.

There are also restrictions on the size of things. In 3 dimensions they should measure up to 180 cm.

For example , it will not be possible to transport an assembled bicycle in a carriage - you will have to disassemble it or transport it for a separate fee.

There are also a number of services that are provided by guides at the request of the traveler free of charge. But few people know about them. This list includes:

  • made the bed;
  • provision of a belt for passengers in the upper bunk for safe sleep and travel;
  • tea set consisting of a cup and spoon;
  • board games (you can ask the guide and play with your fellow travelers);
  • medicines;
  • needle and thread;
  • charging mobile devices;
  • heating food in the microwave (if the train is branded - mandatory, otherwise - at the discretion of the conductor);
  • getting press;
  • a disposable hygiene kit consisting of toothpaste and brush, soap, wet wipes (only on branded trains).

If necessary, a person can use the services of a dining car (for those traveling in luxury cars, meals are included in the ticket price). This entire list of services can significantly increase the comfort of a person’s travel on the train. Therefore, do not forget about your rights while traveling in Russian Railways carriages!

If your train journey will last less than 4 hours, you can refuse to buy a set of bed linen. In this case, be prepared to be denied use of a mattress or pillow. You are also not allowed to use your own bed linen. Remember that each passenger is given a washed and ironed set of bedding.

Small pets and birds can be transported without a veterinary passport starting January 10, 2021. The fee for transporting pets is calculated based on the distance of travel. The exception applies only to guide dogs.

Exotic animals cannot be carried on trains. Even if you have a cage for the animal, you will be refused transportation. There are no exceptions here.

Bicycles can only be transported folded on trains. You can transport a bicycle without disassembling it only in the vestibule of an electric train. Remember the dimensions of a folded bicycle - the sum of three dimensions, the size of your luggage should not exceed 180 cm. Transportation of a bicycle on a train is carried out exclusively in the form of luggage.

Only the conductor can release the stop valve

Even if you are late for the train, you should not hope that someone will break the stop valve in order to get you on the right train. In this case, you should contact the station ticket office and issue new travel documents for the next train with a small surcharge.

The rules of railway transportation stipulate that the stop valve can only be removed in exceptional cases - in the event of an accident or to prevent the train from crashing. It is worth remembering that when the stop valve fails, the brakes are applied for the entire train. If it breaks at high speed, there is a high risk of injury.

Unauthorized release of the stop valve may result in administrative liability. Each case on railway transport is investigated individually. If one of the passengers is injured during an unauthorized breakdown, the offender may face criminal liability.

Russian Railways rules allow taking photos and filming for personal use if these actions do not threaten the safety of other passengers and do not disrupt the operation of railway transport.

It is worth remembering that excessive enthusiasm for filming may attract the attention of police officers on transport.

About smoking on the platform

From February 15, 2021, there is a ban on smoking regular and electronic cigarettes on long-distance trains. The exception is commuter trains, which run a distance of no more than 200 km.

Traditional cigarettes have been banned from smoking since 2014. The only way out for smokers is to smoke while on the platform. But even here you can smoke if it is located at a distance of more than 15 meters from the entrance to the station.

When traveling on trains, you must not drink beer or wine. Consumption of alcoholic beverages is permitted only in the dining car. If you decide to celebrate a holiday or a pleasant meeting with fellow travelers, be prepared to pay a fine of 100-300 rubles for drinking beer drinks and 500-700 rubles for drinking stronger alcoholic drinks.

Karaoke lovers should remember the quiet time. No noise is allowed between 11 p.m. and 6 a.m. During the day you can sing songs, however, if other passengers do not object to this.

About gambling

Since 2009, there has been a ban on gambling at train stations. This does not apply to passenger train carriages. You need to be prepared for the fact that the guides may have questions about this. What if they turn to the police, suspecting your company of fraud.

You can replace cards with chess. You can ask the conductor for them. Despite the fact that the number of chess sets may be limited, passengers of reserved seat and compartment carriages have the right to request them for an exciting pastime.

Surely you have heard the conductor ask you to collect and return bed linen. The conductor's job description states that his direct responsibilities include cleaning the bed linen after passengers leaving the train.

However, you can help the guide by showing respect for his work. This is completely voluntary.

After boarding the train, the conductor is obliged not only to provide you with linen, but also to make your bed upon request. Elderly and disabled people can get help with this free of charge.

If during the trip you stain your linen, for example, spill coffee on it, you can ask the conductor for a set of new bedding for an additional fee.

The following discounts and promotions are available for children's train tickets in 2021:

  1. For children under 5 years old. Travel is free with one condition - the child will sleep in the same bed as the accompanying parent. Valid on an ongoing basis.
  2. For children from 5 years old. The discount on the total ticket price is 65%. In this case, the baby is provided with a separate seat. The tariff is usually used by schoolchildren throughout the school year.
  3. Category from 10 years. Travel savings - 50%. Not valid for students of secondary education institutions aged 14 years or older.
  4. Trip to the CIS countries, the Baltics, Abkhazia. Russian Railways provides a 65% discount that works on an ongoing basis.
  5. Travel to Paris, Vienna, Prague, Nice. In this case, the parent will save 50% of the cost of the child's ticket. Also valid all year round.
  6. “Happy Holidays” promotion. The discount is also 50%, but only from June 1 to August 31.
  7. Free travel to all destinations. This category includes disabled children, orphans, from large and low-income families.
  8. 100% discount. Provided to a second child under 10 years of age, regardless of the number of accompanying adults, but for a SV carriage.

Traveling with animals

In some cases, it may be necessary to buy back the entire compartment.

Animal owners are personally responsible for compliance with sanitary standards in the carriage. Large dogs are only allowed in the compartment. It is necessary to use a muzzle and a leash.

At the same time, the accompanying persons are obliged to buy all the seats in the compartment. Large include dogs that cannot be placed in a carrier with parameters in three dimensions exceeding 180 cm in total.

Power supply guarantee U1

Food offered to railway passengers is prepared by specialized companies and contractors. They cooperate with Russian Railways and regularly supply ready-made meals in special plastic containers to preserve the freshness of food.

U1 services are not provided in reserved seat sleeping cars. Meals are offered only in high-comfort carriages, and the price of food is included in the amount you paid at the ticket office or online for the ticket.

There are several types of services with different numbers of meals:

  • U0 – without food;
  • U1 – service with one meal;
  • U2 and U3 – services with two and three rations, respectively.

You can find out which category your seat in the carriage belongs to using the information printed on the ticket. Service U1 and other types of services are prescribed in the 7th line of the document.

Ride on the top shelves

According to the law, citizens who have purchased tickets for the upper seats have the right to sit only in these seats .

Moreover, this applies not only to the person himself being on the top bunk, but also to the placement of his luggage, hand luggage, and food.

The right to use the luggage compartments under the lower shelves and the table belongs exclusively to the occupants of the lower shelves .

In practice, such a condition is irrelevant , since the inhabitants of the lower shelves always agree to provide their neighbors with the opportunity to place bags in the luggage compartment, sit on the lower shelf and eat food at the table.

Temporary stop

Any person traveling along a long-distance route has the right to get off at any station along the way and interrupt the journey for up to 10 days .

When making a temporary stop, you must go to the local ticket office within 3 hours after arriving at the selected station and present your ticket.

An employee of the institution will put a certain mark confirming the citizen’s right to resume the trip (maximum - after 10 days).

Without this mark, the ticket is not valid and cannot be presented to continue the trip.

If the travel conditions change (upgrading the category of a carriage, choosing a more distant station), the citizen pays the missing amounts and a re-registration fee. If the choice is made in favor of a cheaper carriage and a closer destination, the difference in price is not refunded.

Resumption of travel is only possible with the same carrier from which the ticket was originally purchased.

Legal status of railway transport passenger

Legislation has endowed a citizen traveling by rail with certain rights and responsibilities.

Rights

The rights of a railway transport passenger are specified in Art. 83 No. -FZ. According to the specified legal acts, the user of the rail transportation service has the right:

  1. Change your seat to another free one, even if it is in a carriage of higher comfort. To do this, you will need to contact the head of the train and pay extra for another seat (if necessary). If a passenger changes a seat to an equivalent one, no additional payment will be required;
  2. At any time, without leaving the train, arrange hot drinks for yourself. The conductor of each car must constantly maintain a certain temperature of the water in the titanium. In addition, he is obliged to offer passengers hot tea or coffee with dry confectionery at least 3 times a day for an additional fee;
  3. Go on a trip earlier than the date indicated on the ticket. To do this, you need to obtain information about the availability of free seats on the departing train and contact the railway station ticket office to mark an early departure. There is no need to pay extra for this service;
  4. When traveling on a long-distance train, a passenger may linger at one of the stations longer than the train costs. The maximum delay time cannot exceed 10 days. To take advantage of this opportunity, the passenger will need to notify the train employee no later than 3 hours after arriving at the stop. After the agreed time, the client will continue to his destination. In order to be able to stay, the passenger will need to pay the cost of a reserved seat from the stop to the destination;
  5. If during the journey a passenger develops health problems due to which he cannot continue the trip, he needs to get off at the nearest station and seek medical help. To ensure that the ticket does not disappear, you will need to present a certificate of illness and after recovery, the passenger will be able to continue the journey on another train;
  6. If you have a ticket, while waiting for the train (no earlier than 24 hours before departure) you can use the toilet located in the station building for free. Passengers on a stationary train also have the right to free use of the restroom;
  7. Carry with you a child under 5 years of age without providing him with a separate seat. Children aged 5-10 years must purchase tickets. A travel document for this category of passengers is issued with a 50% discount;
  8. In addition to small items, a passenger has the right to carry hand luggage weighing up to 36 kg (in SV carriages - up to 50 kg), while the dimensions of the transported luggage in the sum of three dimensions should not exceed 180 cm.

Also, during the trip, a railway passenger has the right to ask the conductor to provide a branded glass and/or teaspoon. The user also has the right to receive a board game for leisure activities.

In addition to all of the above, the passenger can refuse a set of bed linen. In this case, he needs to be prepared to be refused a pillow and mattress. You cannot use your own bedding during the trip.

Responsibilities

The list of responsibilities of a Russian Railways passenger includes:

  1. Purchasing a travel document (ticket);
  2. Payment for carriage of hand luggage, the size of which exceeds the established standards;
  3. Compliance with the rules for using railway transport;
  4. At the request of authorized persons, present a travel ticket, an identity document or confirming the right to provide benefits.

Attention! The passenger is obliged to keep the travel document until the end of the journey.

What can a passenger expect?

The passenger can return the ticket and get its cost back. The amount of compensation depends on the time of return of the travel document:

  1. If the ticket is returned no later than 8 hours before the train departure, you can get the full cost of the ticket and reserved seat back;
  2. If the ticket is returned 8-2.5 hours before the departure of the train, the passenger will be refunded the full cost of the ticket and 50% of the price of the reserved seat;
  3. If the ticket is returned less than 2.5 hours before departure, the client will only be refunded the cost of the ticket. Money paid for a reserved seat will not be returned in this case.

In addition, if the passenger is late for the train, he can, within 12 hours from the moment the train departs, travel on another train if there are free seats on it. If the delay is due to illness, the ticket is valid for another 5 days. In each of these cases, you will have to pay extra for a new reserved seat.

If the train is delayed or the passenger is late for a transfer to another train due to the fault of the carrier, the client must be refunded the full cost of the untraveled distance.

Early departure, late

The ticket holder can leave for the destination ahead of schedule if there are empty seats on the earlier departing train.

To resolve the issue, you must contact the cash desk employees.

In case of slight delay, a citizen can:

  • get your money back (the cost of the reserved seat is deducted);
  • set off on a different train , paying for a reserved seat, but without paying for a travel ticket.

A minor delay is considered to be less than 12 hours.

If a person has documentary evidence of a valid reason (accident, illness), the application period increases to 5 days.

If a person is late due to a violation of the arrival time of the previous train from which the transfer was made, he has the opportunity to fully return the money or transfer to another train for free.

Russian Railways is discussing three scenarios for passenger transportation in 2021

According to baggage stowage recommendations:

  • for passengers in the upper bunks - on a shelf under the ceiling;
  • for lower passengers - under the berth.

Exceptions are allowed by agreement between passengers, provided that the conflict is resolved on the basis of respect for each other’s rights and personal space.

The traveler should be able to arrange meals and hot drinks without leaving the train. The duty to maintain a certain temperature of water in titanium, among others, is assigned to the conductor of each car.

As an additional mandatory service, the conductor must remind passengers at least three times a day that they can purchase hot drinks for a fee. The carriage must have an adequate supply of coffee, tea and dry confectionery.

  1. Handing over complete bedding to the conductor at the arrival station is not the responsibility of the passenger. This action is specified in the job description of a railway employee as collecting bed linen and handing it over to a contractor for washing.
  2. The conductor must have branded glasses and teaspoons freely available.
  3. You can contact a railway employee if you need to mend something or sew on a button.
  4. Organize your leisure time by asking the carriage employee for board games.
  5. Medicines from the first aid kit are available to those who are injured for any reason.

If you need to leave urgently, but there is no information at the ticket office about available seats on departing trains, purchase a ticket for an available train. Then they find out whether there are any seats left on the departing train, and put a mark about the departure earlier on the purchased travel coupon.

Being late for a route does not mean losing your right to travel. There are two options for further action:

  1. Travel on another train, paying for a reserved seat (the cost of a seat). In this case, the price will correspond to the purchased tariff.
  2. Get your money back, having lost the price of a reserved seat from the fare.

Not only lateness entitles you to a refund of your travel pass.

Depending on the period, the amount received is calculated:

  • 8 hours before departure, the entire amount spent on purchasing the ticket is refunded;
  • within a period of 8 to 2 hours before the departure of the train, the paid journey at the tariff and 50% of the reserved seat are refunded, based on the comfort of the selected train;
  • Returning immediately before departure entitles you to receive only payment for the trip according to the tariff; the cost of the seat is not refundable.

The reason for the delay could be the railway itself, if a transfer was planned during the trip, but the first train arrived at the station very late and it was not physically possible to get on the next flight on time. In this case, the cost of travel on the second leg of the route is reimbursed in full, and the passenger has the right to request a ticket for another train completely free of charge.

Cancellation, delay

In case of cancellation or delay of the train, the following is allowed :

  1. return the money;
  2. receive a penalty in the amount of 3% of the ticket price for each hour of delay (situations where the delay of the train occurred due to circumstances beyond the control of the employees are not taken into account);
  3. go to court to compensate for the damage caused (financial, moral).

Return

Due to personal circumstances, a citizen may decide to return a previously purchased ticket.

The amount of money received back directly depends on the timing of this return:

  • more than 8 hours – the entire amount;
  • from 2 to 8 hours – full ticket price, 50% for a reserved seat;
  • up to 2 hours – only the cost of the ticket.

When purchasing a ticket at the station, you have the right to ask the seller to help you choose the most comfortable seat available. To avoid mistakes, study the seating plan in advance. For example, many travelers prefer to avoid side seats and areas near restrooms. The choice of shelf depends on your personal preferences: some people like to sleep on the bottom, others on the top shelf.   1. Free ride for a child

Children under 5 years of age do not need to purchase train tickets (of course, if they do not need to occupy a separate shelf). Children from five to ten years old receive a significant discount on travel.

  1. Opportunity to pause

The passenger can take a break during the journey. In this case, the validity of the purchased ticket is extended for a maximum of ten days. To stop, you must notify the administration. This must be done four hours after you arrive at the station. To extend your ticket, you need to pay the price of a reserved seat ticket, which is equal to the price of using a seat in the carriage.

  1. Travel break due to illness

If a passenger gets sick, his ticket is not lost. You just need to get off the train at any station and get all the necessary medical care. You also need to take a certificate, which will become the basis for obtaining a new ticket.

  1. Opportunity to get your travel money back

If the flight is canceled or significantly delayed for any reason, Russian Railways is obliged to refund passengers the full cost of the purchased ticket. In this case, the amount of compensation does not depend on the return period.

  1. Possibility of missing the train

If a passenger misses his train, he has the right to travel on another within 12 hours. In this case, you will have to pay extra for travel in a reserved seat carriage. If the delay is due to injury or illness, you can leave with an additional payment within five days. The alternative is to receive a refund for the missing ticket. However, the cost of travel in a reserved seat will be deducted from the ticket price.   1. Travel without underwear

If you are traveling during the day or prefer to use your own underwear or sleeping bag, then you do not have to pay for the kit provided by Russian Railways. Sometimes there are attempts to impose underwear, including its prices in the fare. However, according to current rules, a passenger may not pay for linen if he does not intend to use it. This must be reported to the cashier when paying for the ticket. However, you need to remember that if you refuse to pay for linen, you will automatically lose the right to take a pillow and a soft mattress: these are the current sanitary standards.

  1. Discount when purchasing tickets for a group of tourists

If you buy tickets for 10 or more people at a time, the discount can be quite impressive: up to 40%. The size of the discount depends on the season and the number of group members.

  1. Baggage transportation

Passengers can carry luggage weighing up to 36 kilograms free of charge in compartment and reserved seat carriages. In SV class carriages, the weight of cargo can reach 50 kilograms. Additionally, at no charge, a passenger can carry fishing rods, skis and other items that do not exceed one meter in length. Strollers and bicycles can only be transported folded.

  1. What services is the conductor required to provide?

The passenger has every right to ask the conductor to make his bed. This service is included in the ticket price and is the direct responsibility of the conductor. Of course, most people cope with this task themselves. However, for pregnant women, people with disabilities and the elderly, the bed must be made.
