How to return a working cell phone to the store

  • If the buyer wants to return money for a defective product, the seller will have 10 days to write a response. If the result is positive, then the buyer will be paid all the money spent;
  • The responsible person of the seller may refuse to accept the goods and return the money to the buyer. This happens in situations where the item has become unusable due to the fault of the buyer;
  • If the product is defective due to the fault of the seller or the transport company, compensation may be denied. To do this, a special examination is performed, which allows us to determine what caused the malfunction.

On average, money for goods is returned to the buyer within 10 business days. If the return is made through a bank, then another 3 to 30 days can be added to the standard period. This period will be required by the financial structure in order to make the return.

It is worth remembering that for each day of delay the guilty party pays a penalty, its amount is established in accordance with the contract. If this issue is carried out without a contract, then the amount of the penalty will be equal to 1% of the cost of the goods.

    1. Pack the purchased phone and take it with you along with a receipt confirming the purchase, as well as your passport. You have the right to a refund even without a receipt, however, then the process will be a little more confusing.
    2. Go to the seller and describe the problem in detail to him, pointing out the defect on the spot.
    3. Without leaving the cash register, write a request for a refund for the phone. Be sure to have two copies, one of which you will take with you. Each one must bear the signature of a store employee confirming the fact of your application.
    4. You will be asked to fill out an acceptance certificate for the mobile phone, where you need to note its general condition, malfunctions, the presence of any defects or their absence.
    5. Wait for a decision. It can be announced immediately, or no later than 10 days from the date of application.

    The store may doubt that the phone you received is problematic and send the device for examination, which must take place within 10 days. Few people use this, but you have every right to attend it in person - the seller is obliged to notify about the exact place and time of the event. The results of the examination will determine whether it will be possible to return the phone back or not.

    The period for filing claims in connection with a malfunction of the phone is limited to the warranty period, and in the absence of an established warranty it is 2 years, provided that the consumer proves that defects occurred before the product was transferred to him or for reasons that arose before the time of purchase (Article 18, paragraph 6) .

    Important: the absence of payment documents confirming the purchase, according to the law, cannot be an obstacle to returning the goods, regardless of its quality (Article 18, paragraph 5 / Article 25, paragraph 1).
